Customer entitled to obtain a refund for unpaid goods or services: HC

Jaipur: The Jaipur Bench of the Rajasthan High Court has held that the customer is entitled to obtain a refund for unpaid goods or services. After hearing a petition filed by Maple Luxury Homes in Bapu Nagar, Jaipur, the High Court has said that before rejecting any refund, it is necessary to give satisfactory reasons so that the taxpayer can complain to the concerned authorities.

Advocate Ravi Gupta, on behlaf of the petetioner, told the court that the applicant for a flat being constructed by the firm had deposited the GST amount along with the payment of various installments. When the booking was canceled by the builder firm in the department after the death of the applicant of the flat, the department issued a show cause notice to the flat builder.
