WHEN DEFAMATION CANNOT BE PRESUMED 'THE RAJASTHAN HIGH COURT JUDGMENT AND ITS SIGNIFICANCE FOR INDIAN MEDIA'

The Rajasthan High Court’s judgment in M/s Rajasthan Patrika Pvt. Ltd. and Gulab Kothari v. State of Rajasthan and Another, delivered by Justice Ashok Kumar Jain on October 1, 2026, raises an important question at the intersection of press freedom, individual reputation and criminal justice: can a newspaper’s management and editor be subjected to criminal proceedings merely because a report has appeared in their publication, without specific allegations or evidence establishing their role, intention or involvement?

The Court’s answer, on the facts of this case, was clear. The criminal proceedings against the newspaper company and its Editor-in-Chief could not stand when the essential ingredients of defamation were absent and no specific role had been attributed to them.

Quashing the proceedings, the Court held that criminal process cannot be set in motion as a matter of course, particularly where the fundamental right to freedom of speech and expression is implicated.

The judgment is significant because it insists that the law must be applied with precision. It draws a necessary distinction between accountability for a defamatory publication and the indiscriminate prosecution of individuals or institutions simply because they are associated with a newspaper.

The case arose from a 2003 criminal complaint by a Rajasthan lawyer alleging reputational harm through pamphlets, demonstrations, loudspeaker announcements and a newspaper report.

The trial court took cognisance under Sections 500, 501 and 502 IPC in April 2004, a decision upheld in November 2005, before the matter reached the High Court.

The Court’s scrutiny focused on a fundamental deficiency: the complaint and supporting statements did not establish a specific role for these petitioners in the alleged campaign.

The Court found no evidence linking the newspaper’s management to pamphlet distribution, demonstrations or conspiracy, stressing that the alleged acts did not automatically establish their participation or common intention.

This distinction lies at the heart of the judgment. Defamation is a specific offence, not a general accusation, one of the judgment’s most important contributions is its examination of what legally constitutes defamation.

The Court reiterated that under Section 499 IPC, defamation requires an imputation, its publication, and the requisite intention, knowledge or reason to believe that it would harm another’s reputation, as recognised in Muhammad Abdulla Khan v. Prakash K.

This is a crucial distinction. A publication may be controversial, unwelcome or damaging to someone’s public standing without necessarily satisfying every legal requirement of criminal defamation. Conversely, a publication that meets those requirements cannot escape scrutiny merely because it appears in a newspaper.

The law must examine the substance of the imputation, the circumstances of its publication and the responsibility of the person accused. The question is not simply whether a complainant has objected to a report, but whether the allegations and supporting material disclose the ingredients of the offence against the particular accused.

The Court’s reasoning reinforces this principle by examining the actual complaint and witness statements rather than accepting the allegation of defamation as sufficient in itself. For Indian journalism, this distinction matters enormously.

Reporting on public controversies, legal disputes, allegations and competing claims is an essential part of the press’s democratic function.

If every allegation of reputational injury automatically translated into criminal proceedings against the editor and management, the legal process itself could become a source of pressure on editorial decisionmaking. The judgment does not erase the distinction between criticism and defamation.

It demands that this distinction be established through law and evidence, rather than assumed from the existence of a complaint. This judgment also answers a crucial point clearly - ownership is not proof of criminal involvement.

Perhaps the most consequential aspect of the judgment concerns the responsibility of a newspaper’s corporate management. In paragraph 35, the Court observed that ownership of a newspaper does not, by itself, make the company liable for defamation.

To establish the company’s role and involvement in the present case, it was necessary to show that its board of directors or management possessed the requisite intention, knowledge or reason to believe that the news article was being published to harm the complainant’s reputation.

This observation addresses a recurring concern in media organisations: the tendency to extend allegations concerning a publication to people whose names appear on the organisational chart, without adequately establishing their individual involvement.

A newspaper is a complex institution. Ownership, editorial leadership, reporting, editing, printing, distribution and corporate administration may involve different individuals performing different functions. Their responsibilities cannot be treated as interchangeable for the purpose of criminal liability.

The judgment does not establish blanket immunity for management or suggest that senior executives can never be held responsible for defamatory publications. Rather, it insists that the legal basis for their prosecution must be established.

This has particular significance for the media industry, where senior editors and management personnel can face substantial professional and reputational consequences even before a case reaches trial. Criminal proceedings themselves can impose costs, consume time and create pressure on an organisation. The correct legal approach is neither automatic liability nor automatic immunity.

It is individualised accountability based on the applicable law and the material on record. The second major principle concerns the allegation of conspiracy.

The Court found no evidence of a meeting of minds between the newspaper’s management, Editor-in-Chief and other accused, nor that witness statements established their involvement in the alleged conspiracy.

This is an important safeguard against guilt by association. The fact that a newspaper reports an event does not, without more, establish that its management organised the event.

The judgment therefore draws an essential line between reporting on an event and participating in the conduct being reported. That distinction is indispensable to independent journalism.

The Court considered precedents under the Press and Registration of Books Act, 1867, including Gambhirsinh R. Dekare v. Falgunbhai Chimanbhai Patel, recognising an editor’s statutory responsibility for newspaper content.

However, it held that an editor’s designation alone cannot establish criminal liability without evidence of involvement in the alleged publication or conspiracy.

The judgment neither abolishes editorial responsibility nor grants editors immunity; it reiterates that criminal liability must be determined by the applicable law and the specific allegations and evidence against each individual.

For the media, this is a meaningful clarification. Editorial accountability must remain real, but it cannot be reduced to a rule that every editor is automatically criminally answerable whenever a complainant disputes a report.

The constitutional significance of the judgment emerges from its treatment of Article 19(1)(a), which guarantees freedom of speech and expression, subject to the reasonable restrictions permitted under Article 19(2), including defamation.

The Court relied on the Supreme Court’s decisions in Subramanian Swamy v. Union of India, Arnab Ranjan Goswami v. Union of India and Vinod Dua v. Union of India, among other authorities.

These decisions recognise both the importance of reputation and the need to protect legitimate expression from unwarranted criminal proceedings.

In a vibrant democracy like India there is a need for the law to protect journalistic freedom within the ambit of Article 19(1)(a) of the Constitution of India.

It would not only encourage freedom of press but also help in nurturing democratic values in the society. The judgment’s significance extends beyond the media because it addresses the judicial responsibility involved in issuing criminal process. Issuing summons is not a trivial administrative step.

It initiates a criminal process with consequences for the person summoned. Courts must therefore examine whether the allegations and supporting material provide sufficient grounds for proceeding against each accused.

The judgment’s approach is to distinguish between the existence of a grievance and the existence of a legally sustainable accusation against a particular person.

For the judiciary, this offers a useful reminder that judicial application of mind requires attention to the ingredients of the offence, the role attributed to each accused and the material available on record.

For the media, it provides a measure of protection against proceedings founded on association rather than adequately pleaded involvement.

The practical implications of what the judgment means for Indian journalism are substantial, but they must be understood within the limits of the ruling.

First, media organisations should continue to maintain rigorous editorial standards, verify allegations and exercise appropriate care before publication.

Nothing in this judgment removes those responsibilities. Second, a complainant seeking criminal action must establish the legal basis for proceeding against the particular individuals or entity accused.

Corporate ownership, senior designation or the mere appearance of a report in a publication cannot replace the necessary examination of the relevant allegations and evidence.

Third, allegations of conspiracy require a legally sustainable basis connecting the accused to the alleged common design. Reporting an event and participating in it are distinct acts.

Finally, courts must remain attentive to the difference between a publication that may legitimately attract criticism or legal scrutiny and one that satisfies the requirements of criminal defamation.

The distinction protects both individual reputation and the constitutional space necessary for journalism. The judgment does not settle every possible question concerning media liability, nor does it confer a general immunity on newspapers.

Its importance lies in the narrower, more defensible proposition that criminal proceedings cannot be sustained against particular accused persons when the essential ingredients of the offence and their specific involvement are not established by the material before the court.

This judgment by Rajasthan High Court is a significant reaffirmation of the principles that should govern criminal defamation proceedings involving the media.

Its central contribution is the insistence that the law must distinguish between an allegation and its legal foundation, between ownership and individual responsibility, and between reporting an event and conspiring to bring it about.
