Raj High Court issues notices over organ transplant case with fake NOC
Jaipur: The Rajasthan High Court has issued notices to the involved parties in a case related to an organ transplant facilitated by a fake NOC. The court questioned, “Why was an FIR registered instead of filing a complaint?”
The notice has been issued to the ACS Home Dept, ACS Health Dept, the competent authority in medical education, the Additional Police Commissioner, and the ACP Gandhinagar, demanding a response.
The orders were passed by a single bench of Justice Narendra Singh Dhaddha in response to a petition filed by urologist Dr. Sandeep Gupta. Advocate Hemant Nahta, representing Dr. Gupta, argued before the court that an FIR cannot be registered under the Human Organ Transplant Act. He argued that the police do not have the authority to arrest on their own. The police also do not have the right to submit a charge sheet. The petition requests that Dr. Gupta’s arrest be declared illegal and seeks compensation of Rs10 lakh for each day of his detention.
