Conference endorsed supremacy of legislature, judiciary should respect constitutional boundaries: Birla

 

Jaipur: The 83rd All India Presiding Officers Conference here endorsed the view that the judiciary should respect its constitutional boundaries and underlined the supremacy of the legislature, Lok Sabha Speaker Om Birla said on Thursday.

This comes a day after Vice-President and Rajya Sabha Chairman Jagdeep Dhankhar slammed the "one-upmanship and public posturing" from judicial platforms.
Nine resolutions underlining the need for all organs of state to respect the Constitutional boundaries enshrined in the Constitution were passed at the conference, Birla said.
"All organs of the Constitution should respect their constitutional boundaries. We respect the judiciary and underline its independence but only the legislature has the right to form law and it is supreme," Birla told reporters after the conference.

A resolution calling for the introduction of a code of conduct for MLAs and MPs to check indecorous and unparliamentary conduct was also passed, he added.
"It has also been decided that a code of conduct for members be introduced in the rules for bringing about an effective check against indecorous and unparliamentary conduct," Birla said.

In a separate resolution, the presiding officers underlined the need for consensus among political parties for not disrupting the House during Question Hour, the Lok Sabha Speaker said.
Speaking at the valedictory session, Birla talked about the resolutions unanimously passed and said there was consensus among the presiding officers that all three branches of state should respect their constitutional boundaries.

Underlining the "primacy of the people" in lawmaking through legislative bodies, the conference "reposed confidence in the principle of separation of powers and exhorted that all organs of state should respect the constitutional boundaries enshrined in the Constitution of India", Birla said.
It was also resolved that the rules of procedure and the conduct of business of legislative bodies should be comprehensively reviewed.

In another resolution, it was proposed that model uniform rules should be formulated by incorporating the best practices to ensure productive functioning of the Houses of legislature.
The conference also passed a resolution extending support to the government on chairing the G20 and Parliament 20. A resolution to project India as 'Mother of Democracy' and a global leader in the causes of equity, inclusivity, fraternity, peace and sustainable lifestyle was accepted, the Speaker said.

Resolutions on providing education, particularly to women and youth in constitutional provisions, instituting an annual best legislature award for legislative bodies and joining the National Digital Grid for legislative bodies in the interest of greater efficiency were also passed.(PTI)
