Modi’s ‘Naya Kashmir’!

New Delhi: The Supreme Court on Monday upheld the Modi government’s decision to abrogate Article 370, which bestowed special status to J&K and the carving out of Ladakh as constitutionally valid. The court has also recommended the government to form a truth and reconciliation commission to record the human rights abuses in J&K by both state and non-state actors.

Reading out verdict, CJI said that J&K did not retain element of sovereignty after joining India. “J&K became an integral part of India as reflected in Articles 1 and 370 of the Constitution,” he said that there are 3 judgments by the 5-judge bench on issue.

Rejecting petitioners’ arguments that no irreversible action can be taken by Centre during President’s rule, Supreme Court said, “Every decision taken by Centre on behalf of state during presidential rule can’t be challenged”.
