"Mamata Banerjee's govt was taking forward appeasement unconstitutionally: JP Nadda after Calcutta HC order scrapping OBC certificates
Kolkata: Tearing into the ruling TMC in West Bengal after the Calcutta High Court cancelled all OBC certificates issued in the state after 2010, BJP President JP Nadda on Thursday said that the court's judgement shows how CM Mamata Banerjee-led government was taking forward appeasement unconstitutionally.
He said that Prime Minister Narendra Modi had raised this issue during the election campaigns and that the leaders of the INDI alliance are shredding the constitution.
"Calcutta High Court has cancelled the OBC reservation given to the Muslims under the OBC quota subcategory. The Calcutta High Court has also cancelled OBC certificates issued In West Bengal to Muslims from 2010 to 2024. Both these judgements show how Mamata Banerjee's government was taking forward appeasement unconstitutionally or can be said that the Muslim agenda was being taken forward," the BJP President said.
"PM Modi had raised this issue during the election campaigns- how Mamata Banerjee, Rahul Gandhi and other leaders of the INDI alliance are shredding the constitution," he added.
Nadda further slammed CM Banerjee on her remark that she does not agree with the decision of the High Court and said that there is no one above the law.
"It is written clearly in the Constitution that reservation will not given based on religion. Mamata Banerjee said that she does not agree with the decision of the High Court. There is no one above the law. PM Modi quoted the constitution and said that the reservation is not given based on religion," he said.
JP Nadda also targeted Congress leader Rahul Gandhi over his silence on the Calcutta HC judgement and said that the people of the country will teach such people a lesson in this election.
"Rahul Gandhi roams around with a copy of the constitution but when the (Calcutta) High Court gives a decision on such an issue and Muslim appeasement is exposed then they remain silent. The people of the country will teach such people a lesson in this election. The people of West Bengal also will teach Mamata Banerjee a lesson," the BJP President said.
After the Calcutta High Court cancelled OBC certificates issued in West Bengal after 2010, Mamata Banerjee said she would not accept the judgement and "OBC reservation continues and will always continue".
Addressing a poll rally at Khardah under the Dumdum Lok Sabha constituency, she said, "I heard a judge passing an order, who has been very famous. The Prime Minister is saying that minorities will take away the Tapasheeli reservation, can this ever happen? Minorities can never touch the Tapasheeli or tribal reservation, but these mischievous people (BJP) get their work done through agencies, they have got the order through someone but I will not accept this opinion. Those who have given the order should keep it to themselves, we will not accept the opinion of BJP, OBC reservation continues and will always continue."
The Calcutta HC on Wednesday cancelled all OBC certificates issued in West Bengal after 2010. The court has directed the West Bengal Backward Classes Commission to prepare a new list of OBCs in accordance with the 1993 Act.
Those who were on the OBC list before 2010 will remain. However, after 2010, OBC nominations have been cancelled. Approximately 5 lakh OBC certificates are set to be cancelled.
After 2010, those who have jobs under the OBC quota or are in the process of getting them cannot be excluded from the quota. There will be no impact on their job and they cannot be excluded from the quota.
