Badlapur encounter: Petition moved in Supreme Court seeking to form an SIT

New Delhi: A petition has been moved in the Supreme Court seeking to form an SIT to look into the matter of Badlapur encounter and sought to issue direction to Central Government, all the State Governments and Union Territories of the Country to ensure that their law enforcing agencies/police machineries are kept in complete and constant surveillance by use of body-cam while on duty.
The plea was moved by advocate Ghanshyam Upadhyay, who also sought to lodge FIR into alleged police encounter of main accused Akshay Anna Shinde in the Badlapur incident.
The petitioner said that the incident had rocked and shocked the nation and more particularly, the State of Maharashtra, which is now popularly known as Badlapur case.
The petitioner also sought to transfer of investigation to the Central Bureau of Investigation and further said that "considering the political scenario in the State of Maharashtra and further taking into account the fact that very same people/political parties, who are in power/government in the State of Maharashtra, are also partners in power at Central Government level and experience has shown that even the investigating agency like Central Bureau of Investigation is found to be influenced by the people in powers and as a matter of fact, CBI has been found to be acting like a 'caged parrot' as has been observed by this Court."
Hence the petitioner has sought that such SIT consists officials of impeachable character drawn not only from CBI, but also other investigating agencies, which are beyond the direct or indirect control/influence of the State of Maharashtra/political parties who are partners in powers/government in State of Maharashtra.
"In order to ensure further transparency and fairness in the investigation, such SIT needs to be headed by a retired Judge of this Court and the investigation is also monitored by this Court and thereafter, strict actions are taken against policemen and all those who are involved in killing of the said accused by taking law in to their hands," the petitioner urged.
The petition also urged to direct the Central Government, all the State Governments and Union Territories of the Country to ensure that their law enforcing agencies/ police machineries are kept in complete and constant surveillance by use of body-cam while on duty and the Respondents are further directed to submit their compliance report in this regard to the top Court, within such reasonable time as this Hon'ble Court may deem fit and proper.
